5 A BILL FOR AN ACT ENTITLED: “AN ACT REVISING LAWS RELATED TO SCHOOL DISTRICTS TO
6 CLARIFY THAT A SCHOOL DISTRICT MAY NOT OPERATE A SCHOOL OR OFFSITE INSTRUCTIONAL
7 SETTING OUTSIDE THE BOUNDARIES OF THE SCHOOL DISTRICT; AND PROVIDING AN EFFECTIVE
8 DATE AND AN APPLICABILITY DATE.”

10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

12 NEW SECTION. Section 1. Prohibition on operating school or offsite instructional setting
13 beyond district boundaries. (1) The board of trustees of a school district may not operate a school or offsite
14 instructional setting outside of the school district boundaries.
15 (2) This section does not limit:
16 (a) boards of trustees from entering into multidistrict agreements under 20-3-363; or
17 (b) the provision of offsite educational services under 20-7-118.

19 NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an
20 integral part of Title 20, chapter 6, part 5, and the provisions of Title 20, chapter 6, part 5, apply to [section 1].

22 NEW SECTION. Section 3. Effective date -- applicability. [This act] is effective July 1, 2023, and
23 applies to school years beginning on or after July 1, 2023.
