4 A BILL FOR AN ACT ENTITLED: β€œAN ACT ALLOWING MERCHANTS, VENDORS, CREDITORS, OR OTHER
5 PARTIES TO CHARGE CARD TRANSACTION FEES FOR TRANSACTIONS WITH A CREDIT OR DEBIT
6 CARD; AND REQUIRING DISCLOSURE OF THE FEE PRIOR TO COMPLETION OF THE TRANSACTION.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 NEW SECTION. Section 1. Credit card transaction fee. A merchant, vendor, creditor as provided in
11 31-2-102, or other party may charge a card transaction fee of up to 3% of the total amount of a transaction if a
12 purchase or other payment is made with a credit or debit card. A financial institution or credit card company
13 may not prohibit collection of the card transaction fee as provided in this section. A party that chooses to charge
14 a card transaction fee under this section must clearly disclose the fee prior to the completion of the transaction.

16 NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an
17 integral part of Title 31, chapter 2, part 1, and the provisions of Title 31, chapter 2, part 1, apply to [section 1].
