The following is a summary of the House Committee Substitute for HB 3490.

Currently, each city, town, and village, and each county, regardless of classification, has the authority to create a historic preservation commission, and to grant the commission certain powers and authorities.

This bill provides that any property or any building of any public or private college or university has the option to opt in or opt out to the city's historic preservation commission's requirements related to historic preservation.

PROPONENTS: Supporters say that this bill is designed to protect property rights and prevent historic preservation commissions from designating buildings historic without the consent of the property owner.
