HB 3160 -- PRELIMINARY INJUNCTIONS IN JUDICIAL PROCEEDINGS

COMMITTEE ACTION: Voted "Do Pass" by the Standing Committee on Judiciary by a vote of 9 to 4.

This bill allows any party enjoined by a preliminary injunction to appeal the grant of the preliminary injunction.

This bill is similar to HB 3144 (2026).

PROPONENTS: Supporters say that this allows any party to appeal a preliminary injunction. The authority to appeal preliminary injunctions is in Federal code so these bills would allow that in the states. If a state statute were appealed in Federal court, the right to interlocutory appeals would exist. The litigation for Amendment 3 is pending and it’s past the preliminary injunction stage, so this is meant to apply to future litigation. The State has an interest in protecting the welfare of its citizens.

OPPONENTS: There was no opposition voiced to the committee.
