This bill specifies that a prosecutor may refile a case that is dismissed by the prosecutor at any time or a case that is set for a preliminary hearing but is dismissed by the court prior to the hearing being held. However, if the prosecutor or the court dismisses the case a second time, the case cannot be refiled.
