HB 2855 -- WORKERS' COMPENSATION (Voss)

Currently, compensation for a workers' compensation claimant who has a permanent total disability must follow certain rules and guidelines. This bill states that upon the filing of a written agreement signed by the claimant and his or her attorney, the Labor and Industrial Relations Commission of Missouri must change the name, information, or fee arrangement of the attorney or law firm associated with the claimant's case.

Currently, the Commission may review an existing workers' compensation award and change the amount. This bill states that upon the filing of a new award agreement signed by the claimant and his or her attorney and the new attorney, the Commission must change the name, information, or fee arrangement of the attorney or law firm associated with the claimant's case.

Current law allows the Director of the Division of Workers' Compensation to impose taxes or surcharges for different purposes relating to the administration of workers' compensation, with such tax rate being rounded up to the nearest one-half of a percentage point. This bill modifies the tax or surcharge rates to be rounded up to the nearest one-tenth of a percentage point.
