This bill proposes the repeal of sections 56.190 and 540.106 of the Revised Statutes of Missouri and enacts two new sections in their place, which modify the procedures related to grand jury proceedings. Under the new section
56.190, stenographers in the office of the prosecuting attorney are required to take down and transcribe testimony and evidence presented before the grand jury, as well as in criminal court and coroner inquests. Stenographers must be sworn to secrecy regarding the information disclosed in the grand jury room, with the stipulation that any transcribed information will be discoverable as long as all privileged information is redacted.
The new section 540.106 establishes that all grand jury proceedings, particularly those involving testimony from witnesses granted immunity from prosecution, must be recorded. If a person is indicted based on such immunized testimony, the prosecutor is mandated to provide a transcription of that testimony to all defendants. These changes aim to enhance transparency and accountability in grand jury processes while maintaining the confidentiality of sensitive information.
