HB 2526 -- SEX-RELATED CLASSIFICATIONS

This bill creates new definitions for the terms "boy", "father", "female", "gender identity", "girl", "male", "man", "mother", and "woman", as defined in the bill.

This bill creates a new definition for the term "sex", which if used to classify or describe a natural person, means the state of being either male or female as observed or clinically verified at birth. In addition, the term "sex" must be interpreted in the follow ways:

(1) There are only two sexes, and every individual is either male or female;

(2) Individuals with congenital and medically verifiable DSD conditions, as described in the bill, are not members of a third sex and must be accommodated consistent with state and Federal law; and

(3) The term "sex" does not include "gender identity" or any other term intended to convey a person's subjective sense of self, and that "gender identity" and other subjective terms will not be considered synonyms or substitutes for "sex".

This bill repeals certain instances of the word "gender" in the statute and replaces it with the word "sex".
