This bill establishes the criminal offense of engaging in an "adult cabaret performance", as defined in the bill. Such offense is committed if the performance is:
(1) On public property; or
(2) In a location other than an adult cabaret where the performance is reasonably expected to be viewed by a person who is not an adult.
The commission of this crime is a Class A misdemeanor for the first offense, and a Class E felony for any subsequent offense. This bill will preempt any ordinance or regulation that was adopted or issued prior to August 28, 2026, and will prevent or preempt any future ordinances or regulations that conflict with these provisions.
This bill is similar to SB 764 (2025) and HB 722 (2025).
