HB 2406 -- ADMINISTRATIVE RULES

This bill requires any state agency filing a notice of proposed rulemaking where the adoption carries a fiscal note of $250,000 or more to file notification with the Joint Committee on Administrative Rules. The Committee can hold hearings on any proposed rule or portion thereof at any time. A final order of rulemaking must not be filed with the Secretary of State until at least 30 days after such final order of rulemaking has been received by the Committee.

The rule will not become effective unless the General Assembly adopts a concurrent resolution and either the Governor signs the resolution or the General Assembly overrules a veto from the Governor.

Except for rules adopted pursuant to emergency rulemaking authority or rules required to conform with Federal law or for Federal funding, any proposed rule will be null and void if it does not comply with the provisions in this bill.

The bill requires a state agency to include written approval by the Governor to the Secretary of State with every notice of proposed rulemaking.
