HB 2334 -- UNLAWFUL USE OF WEAPONS

Currently, a person commits the offense of unlawful use of a weapon if the person knowingly engages in certain acts.

This bill includes within the list of prohibitions the act of knowingly carrying a firearm into any area accessible to the public within any "urban area", as defined in the bill, if the person is under 18 years of age.

However, this provision shall not apply if the person is:

(1) Transporting a firearm that is non-functional or unloaded;

(2) Lawfully possessing a firearm in the course of his or her employment;

(3) In the course of target practice or hunting;

(4) Engaged in the instruction of the safe and lawful use of a firearm; or

(5) Engaged in a lawful act of self-defense, or the defense of others.

If a person commits the crime of unlawful use of a firearm under the provisions of this bill he or she shall be guilty of a Class A misdemeanor.
