HB 2308 -- PARENTING TIME

This bill allows a court to order additional periods of parenting time to compensate a parent for the denial of court-ordered parenting time.

The bill requires the ordering of additional parenting time to compensate for the denial of court-ordered parenting time that resulted from an investigation including, but not limited to, an investigation by the Children's Division or any investigative agency, or a protective or restraining order that did not result in a finding of abuse or neglect. This provision does not apply if a party establishes good cause why such an order must not be issued.

The bill stipulates conditions that must be met for the additional parenting time and allows the parent who was denied parenting time to select the times and dates of the additional parenting time.

Nothing in this bill creates a cause of action against any investigative agency or waives sovereign immunity for any governmental entity or employee.
