This bill establishes requirements for competitive bidding on state purchases.
The bill requires that purchases exceeding $10,000 be based on competitive bids and sets additional advertising, notice, and solicitation requirements for purchases of $100,000 or more.
The bill authorizes the Commissioner of Administration to advertise for bids, post notices, solicit bids, reject bids, negotiate contracts under certain conditions, and establish specifications, delivery requirements, and bonding provisions.
The bill authorizes the Department of Natural Resources (DNR) to enter into certain emergency contracts of up to $500,000 to address illegal waste tire sites when urgent action is required.
The bill prohibits state agencies from contracting with vendors that fail to properly remit sales or use taxes.
The bill also authorizes the use of reverse auctions for certain purchases when price is the primary factor in evaluating bids, and requires public justification when a bid is canceled, including information about any plans to reissue the bid, plans to include the canceled bid within another bid, and currently available bids that are similar in nature to the canceled bid.
Rulemaking authority and legislative oversight provisions are included as well.
