This bill requires, before April 1st of each year, 340B-covered entities, as that term is defined in the bill, to report certain information and transactions to the Department of Health and Senior Services concerning the 340B-covered entity's participation in, or on behalf of a covered entity, in the Federal 340B program for the previous calendar year. A full list of the required information and transactions is provided in the bill.
Some of the information required to be reported must be reported by payer type, including commercial, Medicaid, Medicare, and uninsured payer types. The data submitted in the reports required by the provisions of this bill will be considered confidential.
Before November 15th of each year, the Department must prepare a report aggregating the data submitted under the provisions of this bill, submit that report to the General Assembly, and post the report on its website.
A 340B-covered entity failing to provide the information required by the required date will pay a fine of $1,000 per day that the information is past due.
