Currently, the offense of keeping a dangerous dog is committed if a person keeps a dog that has previously bitten a person or a domestic animal without provocation and the dog bites any person on a subsequent occasion. This bill eliminates the requirement that there be a previous bite. The offense of keeping a dangerous dog is currently a class A misdemeanor if the attack results in serious injury and a class E felony if the current and previous attacks result in serious injury. Under this bill, the offense is a class A misdemeanor if the attack results in serious physical injury or serious emotional injury, and it is a class E felony if the current and any previous attacks result in serious physical injury or serious emotional injury.
