HB 1831 -- CHILD PASSENGERS ON MOTORCYCLES AND MOTOR-TRICYCLES

This bill establishes "Calvin's Law", which makes it unlawful for the operator of a motorcycle or motortricycle to allow a child 10 years of age or younger to ride as a passenger while on a highway, unless certain requirements are met. The motorcycle or motortricyle must be equipped with a passenger seat and all passengers under 10 years of age must wear protective headgear.

Currently, a person can not be stopped, inspected, or detained to determine if he or she is in compliance with regard to the wearing of protective headgear when operating a motorcycle or motortricycle. This bill allows for authorities to stop, inspect, or detain such an operator when there is a reasonable basis to suspect that a violation involves a child passenger under 10 years of age. Violations of this provision will be punishable as an infraction and a fine not to exceed $100.

The provisions of this bill will become effective on January 1, 2027.
