This bill allows a court to sentence certain sexual offenders, specified in the bill, to be surgically castrated. The procedure must be administered by the Department of Corrections by a licensed physician. Before a court sentences an offender to surgical castration, there must be a determination by a court- appointed medical expert that the offender is an appropriate candidate for surgery. The determination must be made no later than 60 days from imposition of sentence. If an offender is sentenced to a term of imprisonment, the procedure must be performed at least one week before the offender's release from the correctional center. If an offender fails to appear for purposes of the procedure or refuses to allow the procedure, the offender will be imprisoned for at least three years and for no more than five years without the possibility of probation, parole, or suspension of sentence.
The provisions of this bill will not apply to an offender who is under 17 years old.
