JOINT RESOLUTION Submitting to the qualified voters of Missouri an amendment to Article I of the Constitution of Missouri, by adopting one new section relating to state regulation of contracts.

Be it resolved by the House of Representatives, the Senate concurring therein:

That at the next general election to be held in the state of Missouri, on Tuesday next 2 following the first Monday in November, 2026, or at a special election to be called by the 3 governor for that purpose, there is hereby submitted to the qualified voters of this state, for 4 adoption or rejection, the following amendment to Article I of the Constitution of the state of 5 Missouri: Section A. Article I, Constitution of Missouri, is amended by adopting one new 2 section, to be known as Section 37, to read as follows: Section 37. 1. Except as provided under subsection 2 of this section, no law 2 impairing the rights of private parties in any market or industry to set prices or 3 compensation for goods or services offered or received shall be adopted by the state. 4 2. The provisions of subsection 1 of this section shall not apply to laws involving: 5 (1) Existing industries regulated under state law as of the effective date of this 6 section; and 7 (2) The rights of a community in the use of a shared natural resource. 8 3. The provisions of subsection 1 of this section shall not apply to contracts or 9 agreements in existence prior to the adoption of this section. The terms or obligations of 10 such contracts or agreements shall continue to remain in effect until the termination,

11 expiration or renewal of such contracts or agreements. This section shall not prejudice, 12 impede, or impair any pending action, proceeding, or rights previously acquired. ✔
