Currently, actions for personal injury or bodily injury, including those relating to uninsured motorist coverage or underinsured motorist coverage, must be brought within five years from the date the injury occurred. This bill reduces the time frame to two years from when the injury occurred, for injuries occurring after August 28, 2026.
Currently, civil actions for childhood sexual abuse must be commenced within 10 years of the plaintiff turning 21 or within three years of the date the plaintiff discovers or reasonably should have discovered that the injury or illness was caused by childhood sexual abuse, whichever occurs later. This bill changes the 10 years to 20 years for any action that arises on or after August 28, 2026. It also adds the offense of sexual exploitation of a minor to the definition of "childhood sexual abuse" in this section.
This bill is similar to HB 68 (2025) and HB 1964 (2024).
