Currently, State law provides that, if 30% or more of the owners of areas of land inside of or within a certain distance of an area subject to a particular zoning regulation protest to a proposed amendment to the regulation, the regulation will only become effective when approved by 2/3 of all the members of the legislative body of the municipality.
This bill prohibits any city, by ordinance, charter, or otherwise, from allowing any additional method of repealing or challenging changes or amendments to zoning regulations through an initiative, referendum, or other voting method by residents of the city.
This provision will not apply to any home rule city partially located in any county with a population between 260,000 and 300,000 inhabitants. Upon enactment, this will only apply to home rule cities partially located in Greene County.
