The bill includes a definition for who is regarded as a "family member" for purposes of determining who is entitled to receive benefits that have accrued and are payable at the time of the employee's death.
Under current law, the unpaid and accrued compensation benefit that is due to the deceased employee is paid to the dependents without administration, and if there are no dependents, then to the personal representative or other persons entitled to receive the benefit. Under this bill, if the employee has no dependents, the benefit would be paid to the personal representative, a family member, or other persons entitled to the benefit, as provided in the bill.
This bill is similar to HB 2483 (2024).
