AN ACT To amend chapter 407, RSMo, by adding thereto one new section relating to the sale of wood products.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be 2 known as section 407.3300, to read as follows: 407.3300. 1. Any person advertising or selling all or any part of a wood product 2 shall not engage in any misleading or deceptive practices including, but not limited to, 3 misrepresenting a product as a wood product if the product is not derived or harvested 4 from wood. For purposes of this section, "wood product", means any product derived 5 from wood including, but not limited to, timber and lumber. 6 2. The department of commerce and insurance shall promulgate rules to enforce 7 provisions of this section. Any rule or portion of a rule, as that term is defined in section 8 536.010, that is created under the authority delegated in this section shall become 9 effective only if it complies with and is subject to all of the provisions of chapter 536 and, 10 if applicable, section 536.028. This section and chapter 536 are nonseverable and if any 11 of the powers vested with the general assembly pursuant to chapter 536 to review, to 12 delay the effective date, or to disapprove and annul a rule are subsequently held 13 unconstitutional, then the grant of rulemaking authority and any rule proposed or 14 adopted after August 28, 2025, shall be invalid and void. ✔
