HB 1494 -- THE OFFICE OF THE LIEUTENANT GOVERNOR

This bill transfers by type I transfer the powers, duties, and functions of the Division of Tourism to the office of the Lieutenant Governor.

The bill transfers by type II transfer the powers, duties, and functions of the Humanities Council to the office of the Lieutenant Governor.

The Lieutenant Governor will replace the Department of Natural Resources in the administration and management of several programs, sites, and duties, as specified by the bill. These programs, sites, and duties include, but are not limited to, the following:

(1) The National Historic Preservation Act of 1966;

(2) The State Parks Program;

(3) Marking and maintaining graves of former Governors of the State;

(4) The Arrow Rock State Historic Site;

(5) The Confederate Memorial Park;

(6) Protection of the portrait of Mark Twain in the Mark Twain State Park;

(7) Repair and maintenance of covered wooden bridges which are acquired to or for the use of the State;

(8) Rock Island Trail State Park;

(9) Revenue bonds issued for the purpose of providing funds for the acquisition, construction, erection, equipment, and furnishing of a project as specified in 253.230-253.280, RSMo.

(10) Leasing for the development, construction, maintenance, and operation of resort and related facilities on federal reservoir lands;

(11) The Doctor Edmund A. Babler Memorial State Park;

(12) The Thomas Hart Benton Homestead;

(13) The Antioch Cemetery; (14) The Historic Preservation Revolving Fund;

(15) The State Historic Preservation Act;

(16) Preservation of submerged or embedded abandoned shipwrecks and the Abandoned Shipwreck Act of 1987;

This bill repeals section 620.467. Currently, that section is subject to an expiration clause dated June 30, 2020 and so has not been in effect for over four years.

The bill's provisions related to transferring usage of a sales tax for the acquisition, development, maintenance, and operation of state parks and historic sites from the Department of Natural Resources to the office of the Lieutenant Governor will only become effective upon the passage and approval by the voters of a Constitutional amendment submitted to them by the General Assembly.
