AN ACT To amend chapter 167, RSMo, by adding thereto one new section relating to additives in food provided to students.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 167, RSMo, is amended by adding thereto one new section, to be 2 known as section 167.206, to read as follows: 167.206. 1. As used in this section, "ultraprocessed food" means an article or 2 item commonly used for food or drink as part of a product or meal that contains at least 3 one of the following ingredients or color additives: 4 (1) Azodicarbonamide (ADA) (CAS 123-77-3); 5 (2) Brominated vegetable oil (BVO); 6 (3) Butylated hydroxyanisole (BHA) (CAS 25013-16-5); 7 (4) Potassium bromate (CAS 7758-01-2); 8 (5) Propyl p-hydroxybenzoate or Propylparaben (CAS 94-13-3); 9 (6) Titanium dioxide (CAS 13463-67-7); 10 (7) FD&C Blue No. 1 (CAS 3844-45-9); 11 (8) FD&C Blue No. 2 (CAS 860-22-0); 12 (9) FD&C Green No. 3 (CAS 2353-45-9); 13 (10) FD&C Red No. 3 (CAS 16423-68-0); 14 (11) FD&C Red No. 40 (CAS 25956-17-6); 15 (12) FD&C Yellow No. 5 (CAS 1934-21-0); or 16 (13) FD&C Yellow No. 6 (CAS 2783-94-0).

For the 2026-27 school year and all subsequent school years, no public school 18 or school district shall serve or sell ultraprocessed food on school grounds during the 19 regular school day. 20 3. Nothing in this section shall be construed to prevent a student's parent, legal 21 guardian, or other person having charge, custody, or control of the student from 22 providing the student with food or drink that contains ultraprocessed food during the 23 regular school day. 24 4. (1) Before August first of each school year, each school district shall submit a 25 comprehensive list of all food and drink items intended to be served during the current 26 school year to the department of elementary and secondary education for approval. The 27 list shall include a statement, signed by an authorized school district representative, 28 affirming that each listed food or drink item has been reviewed and is not 29 ultraprocessed food. 30 (2) Upon receipt of the list and statement, the department shall grant a one-year 31 preliminary approval to the school district. 32 (3) (a) If a school district fails to submit the required list and statement or a food 33 inspection reveals the presence of ultraprocessed food in violation of subsection 2 of this 34 section, the department shall notify the general assembly of the school district's 35 noncompliance. 36 (b) If a school district fails to submit the required list and statement or fails a 37 food inspection as described in paragraph (a) of this subdivision for two consecutive 38 years, the department shall withhold any allocated moneys from the school district until 39 the district is in compliance with this section. ✔
