AN ACT To amend chapter 252, RSMo, by adding thereto one new section relating to nest predators.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 252, RSMo, is amended by adding thereto one new section, to be 2 known as section 252.032, to read as follows: 252.032. 1. As used in this section, "nest predator" means the following species: 2 (1) Raccoon; 3 (2) Striped skunk; 4 (3) Badger; 5 (4) Opossum; and 6 (5) Red fox. 7 2. There is hereby established a nest predator bounty program to promote the 8 reduction in numbers of nest predators from the landscape to enhance the nest success 9 of ground-nesting birds in this state. 10 3. The state department of conservation shall pay a bounty of ten dollars for 11 each tail of a nest predator submitted to the department under this section. 12 4. The nest predator bounty program shall be subject to the following: 13 (1) No household shall receive more than one thousand two hundred dollars 14 from the bounty program annually; 15 (2) No more than two million dollars shall be disbursed under the bounty 16 program annually; 17 (3) No individual who is not a resident of this state shall be eligible for a bounty 18 under this section;

19 (4) No tail of a nest predator that has been harvested outside this state shall be 20 eligible for a bounty under this section; 21 (5) No tail from a road-killed nest predator is eligible for a bounty under this 22 section; 23 (6) An individual who desires to harvest nest predators to receive a bounty 24 under this section shall obtain a trapping license from the department. This subdivision 25 shall not be construed to require a landowner who harvests a nest predator on real 26 property owned by such landowner to obtain a trapping license under this subdivision; 27 (7) An individual who submits a nest predator tail under this section shall sign a 28 legal affidavit attesting to the method, date and time, and location of the harvest of the 29 nest predator; and 30 (8) Other requirements established by the department. 31 5. The department may promulgate all necessary rules and regulations for the 32 administration of this section. Any rule or portion of a rule, as that term is defined in 33 section 536.010, that is created under the authority delegated in this section shall 34 become effective only if it complies with and is subject to all of the provisions of chapter 35 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable 36 and if any of the powers vested with the general assembly pursuant to chapter 536 to 37 review, to delay the effective date, or to disapprove and annul a rule are subsequently 38 held unconstitutional, then the grant of rulemaking authority and any rule proposed or 39 adopted after the effective date of this section shall be invalid and void. ✔
