AN ACT To amend chapter 589, RSMo, by adding thereto three new sections relating to the Missouri domestic abuse offender registry, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 589, RSMo, is amended by adding thereto three new sections, to 2 be known as sections 589.750, 589.752, and 589.753, to read as follows: 589.750. 1. The provisions of sections 589.750 to 589.753 shall be known as the 2 "Missouri Domestic Abuse Offender Registration Act". 3 2. For purposes of sections 589.750 to 589.753, the following terms mean: 4 (1) "Domestic abuse", any act of violence, intimidation, harassment, or coercion 5 committed by one family or household member against another including, but not 6 limited to, physical harm, emotional abuse, sexual abuse, or financial control; 7 (2) "Law enforcement agency", any city, county, or state police department or 8 law enforcement entity authorized to enforce laws within the state; 9 (3) "Offender", a person convicted of a domestic abuse offense, which includes 10 but is not limited to, domestic assault, stalking, and harassment; 11 (4) "Registration", the process by which an offender provides personal 12 information to the state that is maintained in a confidential database accessible to law 13 enforcement. 14 3. Any person convicted of a domestic assault offense shall register with the 15 department of public safety within forty-eight hours of the offender's conviction or 16 release from incarceration, whichever occurs later.

Offenders shall furnish to the department of public safety the following 18 information when registering: 19 (1) Full legal name; 20 (2) Aliases; 21 (3) Date of birth; 22 (4) Current residential address and any past addresses from the preceding five 23 years; 24 (5) Current employment information; 25 (6) Current vehicle information, including license plate number and vehicle 26 identification number for each vehicle leased or owned by the offender; and 27 (7) Any other information deemed necessary by the department of public safety. 28 5. Offenders shall update their registration information with the department of 29 public safety within five days of any change to the information required under 30 subsection 4 of this section. 31 6. Offenders shall be required to maintain registration for a duration of five 32 years following the completion of their sentence, probation, or parole. The department 33 of public safety may extend such period based on the severity of the offense and an 34 assessment of risk. 589.752. 1. The department of public safety shall maintain a secure and 2 confidential database of registered domestic abuse offenders. 3 2. Law enforcement agencies shall have access to the registration database to aid 4 in investigations and ensure the safety of victims. 5 3. The department of public safety shall monitor compliance with registration 6 requirements and conduct regular audits of the registration database. 7 4. Any person who fails to register as required under sections 589.750 to 589.753 8 shall be punished as follows: 9 (1) For the first violation of the registration requirement, such person is guilty of 10 a misdemeanor, punishable by imprisonment not to exceed thirty days and a fine not to 11 exceed five hundred dollars; and 12 (2) For a second or subsequent violation of the registration requirement, such 13 person is guilty of a felony, punishable by imprisonment not to exceed two years and a 14 fine not to exceed two thousand dollars. 15 16 The court may impose additional sanctions as it deems appropriate to ensure 17 compliance and to protect public safety. 589.753. 1. The department of public safety shall be authorized to allocate 2 necessary funding and resources to implement and maintain the domestic abuse HB 1337 3
3 offender registration system including, but not limited to, funding for personnel, 4 technology, and training. 5 2. The director of the department of public safety may promulgate all necessary 6 rules and regulations for the administration of this section. Any rule or portion of a 7 rule, as that term is defined in section 536.010, that is created under the authority 8 delegated in this section shall become effective only if it complies with and is subject to 9 all of the provisions of chapter 536 and, if applicable, section 536.028. This section and 10 chapter 536 are nonseverable and if any of the powers vested with the general assembly 11 pursuant to chapter 536 to review, to delay the effective date, or to disapprove and annul 12 a rule are subsequently held unconstitutional, then the grant of rulemaking authority 13 and any rule proposed or adopted after August 28, 2025, shall be invalid and void. ✔
