This bill prohibits health care facilities from requesting covered emergency ambulance services, as defined in the bill, between the hours of 10pm and 6am for any patient who does not have an emergent condition or time-critical diagnosis. However, an emergency department that is at a capacity of at least 80% can request a covered emergency ambulance service between the hours of 10pm and 6am for any patient regardless of the nature of his or her diagnosis or condition.

The bill does not apply to requests for patient transport by an air ambulance service, a hospital-based or hospital-owned ambulance service, or an ambulance service whose employees do not work shifts in excess of 16 hours.
