AN ACT To amend chapter 190, RSMo, by adding thereto one new section relating to emergency ambulance services.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 190, RSMo, is amended by adding thereto one new section, to be 2 known as section 190.252, to read as follows: 190.252. 1. As used in this section, the following terms mean: 2 (1) "Ambulance service", the same meaning given to the term in section 190.100; 3 (2) "Covered emergency ambulance service", any emergency ambulance service 4 that responds to requests for assistance through the emergency telephone service and 5 operates with employees who work shifts of least twenty-four hours; 6 (3) "Emergency department", any emergency department within a health care 7 facility; 8 (4) "Emergency telephone service", the same meaning given to the term in 9 section 190.290; 10 (5) "Emergent", an illness, trauma, or other condition of a patient that is 11 immediately life-threatening such that failure to address it at a specialty facility or other 12 facility that provides for a higher level of care could result in the death of the patient 13 within minutes or hours; 14 (6) "Health care facility", any facility as defined in section 376.1350, including 15 any department within the facility; 16 (7) "Time-critical diagnosis", the same meaning given to the term in section 17 190.100.

A health care facility shall not request a covered emergency ambulance 19 service to provide transportation between the hours of 10:00 p.m. and 6:00 a.m. for any 20 patient who does not have an emergent condition or a time-critical diagnosis. 21 3. Notwithstanding the provisions of subsection 2 of this section to the contrary, 22 any emergency department at a capacity of at least eighty percent may request a 23 covered emergency ambulance service to provide transportation between the hours of 24 10:00 p.m. and 6:00 a.m. for any patient regardless of the nature of the patient's 25 diagnosis or condition. 26 4. The provisions of this section shall not apply to any requests by a health care 27 facility for patient transport by: 28 (1) An air ambulance service; 29 (2) A hospital-based or hospital-owned ambulance service; or 30 (3) An ambulance service that operates with employees who work shifts that do 31 not exceed sixteen hours. ✔
