This bill establishes the "Defend the Guard Act".
The bill specifies that the Missouri National Guard and any member thereof cannot be released from the state into active duty combat, as defined in the bill, unless the United States Congress has passed an official declaration of war to explicitly call forth the Missouri National Guard. The Governor must take all actions necessary to comply with the requirements of this bill.
Nothing in this bill limits or prohibits the Governor from consenting to the deployment of any National Guard member under Title 32 of the United States Code. This bill will be effective on January 1st of the year following notice to the Revisor of Statutes that at least 10 other states have enacted legislation with provisions similar to this bill.
