HB 1202 -- CONDITIONS OF BAIL

This bill puts restrictions on bail for defendants who have been determined to be prior offenders of misdemeanors involving crimes of violence, sexual offenses, or felony offenses in this state or any other state in the last five years. The bill also requires a release hearing to be conducted within 48 hours of arrest, and the prosecuting or circuit attorney will have the burden to prove the defendant poses a flight risk or is a danger to the community.

The bill also requires any executed bail bond to reflect the seriousness of the current charge and ensure the amount is sufficiently high to deter flight.

Currently, a defendant can be required to report regularly to some officer of the court, or peace officer, as ordered by the judge. This bill adds that the offender must meet every 30 days if the offender is a previous offender of certain crimes.
