HB 1157 -- COMPENSATION OF PROSECUTING ATTORNEYS

Currently, a county prosecuting attorney other than in a charter county receives compensation equal to the compensation of an associate circuit judge.

This bill provides that, in a county that passed a proposition authorized by law establishing a lower percentage of compensation for an associate circuit judge, the highest percentage of compensation that was approved by voters will be used to compute the salary of the full-time prosecutor.

Currently, compensation for a part-time prosecuting attorney in any county other than a charter county is prescribed using a statutory schedule based the county's assessed valuation.

This bill repeals that salary schedule and sets the compensation for a part-time county prosecutor as equal to 67% of the compensation of an associate circuit judge.

In a county that passed a proposition authorized by law establishing a lower percentage of compensation for an associate circuit judge, the highest percentage of compensation that was approved by voters will be used to compute the salary of the part- time prosecutor.

The bill also requires part-time prosecutors to devote a minimum of 25 hours per week to prosecuting duties.
