HB 1167 -- COMMERCIAL CHEATING SERVICES

This bill prohibits organizations or individuals from advertising selling, or distributing work products such as assigned tasks, assignments, and exams among others as outlined in the bill with the knowledge that the work product is a violation of the rights of the sponsor, defined to include public schools or universities or any organization that issues credentials or certification.

The bill prohibits an organization or individual from selling or advertising for sell complete tasks for a fee if it would be submitted as a learner's own work and restricts the selling or distribution of confidential exams or assignments.

Penalties outlined in the bill include up to a $5000 fine for each violation or misdemeanor or felony charges for multiple offenses along with civil penalties for damages, legal fees, and other costs.

The bill provides exceptions for tutorial help or research material allowed by the school or university and authorizes courts to preserve the secrecy of any confidential exam or assignment.
