HB 1100 -- MISSOURI STATE SURPLUS PROPERTY CLEARING FUND

COMMITTEE ACTION: Voted "Do Pass" by the Standing Committee on Corrections and Public Institutions by a vote of 11 to 0. Voted "Do Pass" by the Standing Committee on Rules-Legislative by a vote of 10 to 0.

Currently, moneys received by the State from the sale of surplus property must be deposited in the State Treasury to the credit of the Missouri State Surplus Property Clearing Fund. These funds are used for the purpose of paying the costs of conducting surplus property sales.

This bill makes the deposit of moneys received by the State from the sale of surplus property into the Missouri State Surplus Property Clearing Fund optional.

PROPONENTS: Supporters say that this will improve efficiency by allowing the surplus property office to transfer only the necessary administrative costs to the clearing fund, while the bulk of the proceeds of the sales can be transferred directly to the fund that originally purchased the property.

Testifying in person for the bill was Representative Owen.

OPPONENTS: There was no opposition voiced to the committee.

OTHERS: Others testifying on the bill say there is a lot of administrative effort expended to track the different funds which must currently be paid out from the clearing fund. When a vehicle is sold at auction, for example, the proceeds are transferred to the clearing fund, it is manually tracked and the proceeds above the administrative costs manually transferred to the proper fund. The bill would reduce the additional step of the manual transfer. The process could be automated, but the law does not allow it right now.
