HB 1009 -- POST-AWARD NEGOTIATION OF STATE GOVERNMENT CONTRACTS

This bill allows for post-award negotiations with the lowest and best responsive vendor if identified in the solicitation along with the time frame for post-award negotiations. Certain contract provisions must be reserved for post-award negotiations after the notice of award. If the negotiations fail, the Commissioner can cancel the award and award the contract to the next lowest and best vendor.

The Commissioner can waive post-award negotiations if he is satisfied with the lowest and best responsive vendor's proposal.

For contracts to be awarded to multiple vendors, the post-award negotiations can be done separately with all awarded vendors if specified in the solicitation. If the State agrees to any provision in post-award negotiations with a vendor, any other vendor who was awarded a contract in the same solicitation can request the same negotiated provision for their contract which will be added through a written contract amendment.

This bill is similar to HB 1818 (2024).
