HJR 53 -- CRIMINAL RACKETEERING & POSSESSING CHILD PORNOGRAPHY

Upon voter approval, this Constitutional amendment clarifies that nothing in the Constitution or the laws of Missouri will be construed to establish a right to possess or distribute child pornography in violation of federal law or to engage in criminal racketeering activity. The amendment allows the state and local governments in the state to outlaw and punish the possession of child pornography and criminal racketeering activity. The amendment gives every person standing to sue for an injunction against individuals or entities that violate federal laws that prohibit possession or distribution of child pornography or engaging in criminal racketeering activity or against a person or entity that aids or abets the violations. The court must award injunctive relief and reasonable attorneys' fees to any plaintiff who prevails in this type of lawsuit.
