WHEREAS, the 16th Amendment to the Constitution of the United States was 2 ratified in 1913, granting Congress the power to levy and collect taxes on incomes without 3 apportionment among the States or regard to any census or enumeration; and 4 5 WHEREAS, the centralized federal income tax system has led to the growth of a 6 large federal bureaucracy and placed an undue financial burden on American citizens, 7 diminishing the power and sovereignty of individual States; and 8 9 WHEREAS, the framers of the Constitution intended for a limited federal 10 government with taxation authority primarily vested in the States to maintain the balance 11 of power and uphold the principles of federalism; and 12 13 WHEREAS, returning taxation authority to the States will enhance transparency, 14 promote fiscal responsibility, and empower States to manage their own tax collection systems 15 according to the needs of their citizens; and 16 17 WHEREAS, requiring Congress to establish an annual balanced budget as a 18 condition for receiving apportioned State funding would encourage responsible federal 19 spending and strengthen accountability in the budgeting process: 20 21 NOW THEREFORE BE IT RESOLVED that the members of the House of 22 Representatives of the One Hundred Third General Assembly, First Regular Session, hereby 23 call upon the legislatures of all States in the Union to adopt similar resolutions, compelling 24 Congress to propose an amendment to the Constitution of the United States that: 25 26 1. Repeals the 16th Amendment, thereby abolishing the federal government's 27 authority to levy and collect income taxes from individual citizens, effectively dissolving the 28 Internal Revenue Service (IRS); 29 HR 9 2
30 2. Establishes a new constitutional framework, wherein each State shall have the sole 31 authority to levy and collect taxes from its citizens, granting States the flexibility to determine 32 their own taxation methods and policies; 33 34 3. Mandates the apportionment of collected taxes from each State to the federal 35 government based on an annual budget set by Congress, limited to funding constitutionally 36 defined federal functions such as common defense and infrastructure; 37 38 4. Requires Congress to pass an annual balanced budget no later than the start of each 39 fiscal year, clearly specifying the amount of apportioned revenue necessary to fulfill federal 40 obligations. If Congress fails to pass a budget, the States shall not be obligated to remit any 41 apportioned funds to the federal government until a budget is duly enacted and any fiscal year 42 without an approved budget shall result in the suspension of federal tax collection from the 43 States, incentivizing timely and responsible budgetary practices; and 44 45 BE IT FURTHER RESOLVED that the State of Missouri reaffirms its commitment 46 to the principles of federalism, limited government, and fiscal accountability, and urges all 47 States to join in this effort to restore the balance of power between the federal and State 48 governments; and 49 50 BE IT FURTHER RESOLVED that the Chief Clerk of the Missouri House of 51 Representatives be instructed to prepare a properly inscribed copy of this resolution for the 52 President of the United States Senate, the Speaker of the House of Representatives, the 53 presiding officers of each legislative body of the several States, and to each member of the 54 Missouri Congressional Delegation urging their prompt consideration and support for the 55 proposed amendment. ✔
