This bill creates the offense of illegal street racing and specifies any law enforcement officer can authorize the towing of a vehicle that the officer has probably cause to believe has been involved in illegal street racing. Political subdivisions can enact ordinances regarding the towing, impoundment, and recovery of such vehicles.
A person commits the offense of illegal street racing if he or she engages in street racing activity on a public road or highway, obstructs or barricades a street or highway for the purposes of facilitating or aiding street racing activity, consents to their vehicle being used for street racing activity, or interferes with or causes traffic to slow or stop for street racing activity. The offense of illegal street racing is a class A misdemeanor for the first conviction, a class E felony for the second or subsequent conviction, and a class C felony if the act results in serous injury to another person.
The bill also specifies that the driver's license of any person convicted of illegal street racing will be revoked and a court can enter an order of impoundment or immobilzation, as specified in the bill, of an vehicle involved in illegal street racing.
