Currently, a machine gun is defined as a firearm capable of firing more than one shot automatically, without manual reloading, by a single function of the trigger.
This bill amends the definition to include firearms that are capable of firing shots at a rate that is within the range of the typical firing rate of a machine gun, regardless of whether the firearm was originally manufactured with such capability or was modified to have such capability by a switch, Glock switch, auto sear, bump stock, trigger crank, or any other manufactured or homemade component.
Currently, a person commits an offense if such person knowingly possesses, manufactures, transports, repairs, or sells a machine gun in violation of federal law. This bill makes knowingly possessing, manufacturing, transporting, repairing, or selling a machine gun an offense under state law.
