HB 560 -- PUBLIC SERVICE COMMISSION

Currently, any action to recover a penalty or forfeiture or to enforce the powers of the Public Service Commission must be started and prosecuted by the general counsel to the Commission. This bill allows the Attorney General to also start and prosecute such cases.

The bill also includes the affiliate of a utility company in those entities prohibited from engaging in HVAC services. If the Commission receives information that a utility company or its affiliate has provided HVAC services in violations of the prohibition, the Commission must investigate and if finding evidence of a violation, abate the violation and impose required penalties as provided in the bill.

The bill specifies that the Commission may not adopt a rule, tariff, ordinance, or other action that violates the prohibition on a utility or its affiliate providing HVAC services.
