HB 553 -- EPINEPHRINE PRODUCTS

SPONSOR: Violet

COMMITTEE ACTION: Voted "Do Pass" by the Standing Committee on Health and Mental Health by a vote of 13 to 0. Voted "Do Pass" by the Standing Committee on Rules-Administrative by a vote of 10 to 0.

This bill adds single-use epinephrine nasal spray to provisions of statute that permit the possession and self-administration of the medication to treat a student's chronic health condition, such as asthma or anaphylaxis.

The bill authorizes each board of education in this state to grant permission to pupils, as well as each school board in this state to grant permission to school nurses to use this medication.

This bill additionally modifies existing provisions for epinephrine possession, use limitations, and stock supply by adding single-use epinephrine nasal sprays as eligible products.

Current law authorizes qualified first responders, as defined in the bill, to administer epinephrine auto-injectors to a person who is suffering from an apparent anaphylactic reaction. This bill extends that authorization to single-use epinephrine nasal sprays.

This bill is the same as HB 165 (2025).

PROPONENTS: Supporters say that there are around 27,000 students in public schools throughout the State, and nurses have around 50 different diagnoses where the report thereof must be sent to DHSS. When people do have allergic reactions, not everyone is comfortable injecting themselves or someone else, and many rural schools do not even have a school nurse to administer.

Testifying in person for the bill were Representative Violet; Arnie Dienoff; Linda Newman, Missouri Association of School Nurses.

OPPONENTS: There was no opposition voiced to the committee.

Written testimony has been submitted for this bill. The full written testimony and witnesses testifying online can be found under Testimony on the bill page on the House website.
