This bill establishes statutes of limitation for causes of action for any injury to a person with a disability if the injury resulted from abuse, bullying, or neglect and the injury occurred prior to, on, or after August 28, 2025.
If the injured person is under 18 at the time of the injury, the action must be commenced within 37 years after the person turns 18 or within seven years from the date of reasonable discovery of the injury and its causal relationship to the abuse, bullying, or neglect; whichever is later. If the injured person is 18 years old or older at the time of the injury, the action must be commenced within seven years from the date of reasonable discovery of the injury and its causal relationship to the abuse, bullying, or neglect.
