HB 106 -- LAND RECLAMATION

Currently, excavations for the purposes of land improvement where excess minerals that can not be used on-site are removed from the site and are not crushed, screened or subjected to other means of benefication are not required to obtain a surface mining permit. This bill allows the minerals to be subjected to benefication. The bill also repeals the requirement that the site not be designated as a surface mine by the Federal Mine Safety and Health Administration.

This bill is the same as HB 2720 (2024).
