HB 2840 -- CHILD CARE

The bill prohibits smoking or any other use of tobacco or marijuana products in any area of a child care facility that is licensed by the Department of Elementary and Secondary Education. A person in violation of this provision relating to tobacco will be guilty of an infraction, and a person in violation of this provision relating to marijuana will be guilty of a class B misdemeanor.

Additionally, this bill allows the Department to grant a temporary child care license to a child care provider, upon submission of a complete license application to the Department to expand an existing site or add a new location, provided that such provider also submits an approved fire-safety and sanitation inspection for the site being added or expanded.
