Dear Honorable Committee Members, I am a Co-Director of the Inter-Faith Committee on Latin America, an organization that joined the sanctuary movement in 1984 and has worked alongside immigrants and their families ever since. On behalf of the Inter-Faith Committee on Latin America and the individuals and congregations we represent, I urge this committee to reject HCR 47. Sanctuary takes on many different meanings. Sanctuary can be a consecrated place or physical space of refuge and safety. Sanctuary can be a policy of welcome or a commitment to sacred resistance. No legal or standard definition of the term exists. In many cases, sanctuary policies concern a city’s or a state’s role in cooperating with federal authorities to enforce immigration law. Contrary to what many believe, sanctuary policies do not conceal or shelter undocumented immigrants nor do they shield immigrants from deportation or prosecution for criminal activities. As a general rule, the Supreme Court has made clear that it is not a crime for an undocumented immigrant to remain present in the United States. Sanctuary jurisdictions are in compliance with federal law.HCR 47 states that sanctuary policies pose a threat to public safety. However, states and cities that adopt sanctuary policies are actually safer than those that do not. There are, on average, 35.5 fewer crimes committed per 10,000 people in sanctuary counties compared to counties that honor U.S. Immigration and Customs Enforcement detainers. Multiple studies have confirmed these findings or determined that sanctuary policies have no measurable effect on crime rates. No studies have demonstrated a link between sanctuary policies and increased crime.Sanctuary cities and states are also more economically vibrant places. On average, median household income is $4,353 higher in sanctuary counties than in counties that honor detainers. The poverty rate is 2.3% lower in sanctuary counties. The labor force participation rate is also higher in sanctuary counties. Outside of these statistics, there are many reasons that a jurisdiction may choose to adopt a sanctuary policy, including that sanctuary policies allow state and local governments to determine how they will prioritize and allocate their resources.Missouri already has an anti-sanctuary city law on the books. Instead of engaging in political theatrics that would not address the needs of Missourians, it is important for our representatives to focus on issues that are important to us. I urge the Special Committee on Small Business to reject HCR 47 for these reasons.
