HB 2539 -- POSSESSION OF AN OPEN ALCOHOLIC BEVERAGE IN A MOTOR VEHICLE

Currently, vehicle passengers are not prohibited from possessing an open alcoholic beverage. This bill makes it an offense to possess in a motor vehicle an open alcoholic beverage in the "passenger area", as defined. The provisions of this bill do not apply to any passenger in the vehicle for the purposes of transportation for compensation, or in the living quarters of a motor home or house trailer. Only a person who possess an open alcoholic beverage container in violation of the provisions of this bill will be charged with an offense.

The offense of possession of an open alcoholic beverage is an infraction and will not be reflected on any records maintained by the Department of Revenue.

This bill is the same as HB 451 (2023)and HB 2557 (2022).
