This bill requires that children, until the age of two, must be secured in a rear-facing child passenger restraint system, except a child of this age may face forward when the child reaches a highest rear-facing weight or height allowed by the manufacturer of the car seat. Currently, children of at least 80 pounds and more than four feet nine inches in height must be secured, this bill modifies this requirement by adding that the child must also be at least eight years of age.
The bill repeals the provision that exempts from the child restraint laws children in an immediate family when there are less seatbelts than children.
The bill makes all violations of this Section an infraction punishable by a fine of not more that $50 and court cost.
This bill is the same as HB 731 (2023).
