This bill modifies several provisions relating to marijuana, with penalty provisions.

MARIJUANA ON CAMPUS (Section 173.156)

This bill requires that public institutions of higher education allow legally eligible individuals to use medical marijuana on campus.

SMOKING (Sections 171.765, 191.775, 191.776, and 290.145)

This bill also amends the provisions of the law relating to smoking restrictions, known as the "Indoor Clean Air Act", to provide that the smoking of marijuana shall be subject to the same regulations and controls as the smoking of tobacco.

This bill also amends Section 290.145, RSMo, to provide that, in addition to the lawful use of alcohol or tobacco, it shall be improper employment practice to refuse to hire, to discharge, or to otherwise disadvantage any employee for the lawful use of marijuana, unless such use interferes with the duties and performance of the employee.

EARLY RELEASE FOR MARIJUANA-RELATED OFFENSES (Section 217.158)

Any person who is serving a sentence for a marijuana-related offense may petition the sentencing court to vacate the sentence and order immediate release from incarceration. When the petitioner is serving a sentence only for a marijuana-related offense or offenses, the Department of Corrections shall immediately release the person from custody and supervision.

LICENSING (Section 195.778)

This bill specifies that the General Assembly repeals any limits on the number of comprehensive marijuana licenses established in regulations. This bill specifies that the Department of Health and Human Services shall issue a comprehensive marijuana license to any qualified applicant, provided that the Department may deny a license to an applicant to comply with the 10% cap for ownership of licenses established under the Constitution of Missouri.
