The bill prohibits any county, municipality, or political subdivision from imposing or enforcing a moratorium on eviction proceedings unless specifically authorized by state law.
This bill is the same as HB 730 (2023) and similar to HCS HB 1682 (2022).
PROPONENTS: Supporters say that a moratorium is a clear infringement on property rights and against contracts entered into between the landlord and tenant. Eviction is a state law. Having a piecemeal approach among municipalities issuing moratoriums can create chaos.
Testifying in person for the bill were Representative Brown; Missouri Bankers Association; Missouri Association of Realtors; and the St. Louis Apartment Association.
OPPONENTS: There was no opposition voiced to the committee.
OTHERS: Others testifying on the bill say the state needs to be careful about restricting eviction moratoriums during natural disasters, especially if they occur when the General Assembly is not in session.
