HB 1833 -- OFFICE OF ELECTION CRIMES AND SECURITY

This bill establishes the Office of Election Crimes and Security within the Secretary of State's office.

The office shall have the following duties:

(1) Respond to complaints alleging violations of election law;

(2) Review reports alleging violations of election law;

(3) Investigate reports alleging violations of election law; and

(4) Oversee a voter fraud hotline.

Within 30 days of receiving a complaint the office shall notify the person who filed the complaint whether the Office will commence an investigation. The Office of Election Crimes and Security will dismiss frivolous complaints.

The Office of Election Crimes and Security may require the production of records necessary to conduct an investigation. The investigators will be authorized to enter a polling place or office of an election authority in the course of an investigation

If the Office of Election Crimes and Security concludes that a violation of law has occurred, it will submit its findings to the Attorney General and appropriate prosecuting authority.

The Office of Election Crimes and Security will issue an annual report, before January 15th, detailing its findings to the Missouri Governor, Speaker of the Missouri House of Representatives, the President Pro Tem of the Missouri Senate, and the House and Senate committees that deal with election policy.
