HB 1620 -- REVIEW OF PRESIDENTIAL ORDERS

This bill provides that the Missouri House of Representatives may review any executive order issued by the President of the United States if the order has not been affirmed by a vote of Congress and signed into law. Upon review, the House may recommend that the Attorney General and the Governor examine the order further to determine the constitutionality of it and whether the state should seek an exemption from the application of the order or seek to have the order declared an unconstitutional exercise of authority by the President.

No state agency, political subdivision, or any officials or employees of this state or any political subdivision in this state shall implement an executive order that restricts a person's Constitutional rights or is determined by the Attorney General to be unconstitutional if the order relates to the following:

(1) The regulation of business activities or personal behaviors during a pandemic or other public health emergency;

(2) The regulation of natural resources;

(3) The regulation of the agricultural industry;

(4) The regulation of land use;

(5) The regulation of the financial sector through the imposition of environmental, social, or governance standards; or

(6) The regulation of the Constitutional right to keep and bear arms.

This bill is the same as HB 174 (2023).
