HB 1466 -- FIREWORKS

Currently, a county burn ban may prohibit the explosion or ignition of any missile or skyrocket as defined in the 2012 edition of the American Fireworks Standards Laboratory (AFSL). This bill updates the reference for definitions to the 2022 edition of the AFSL.

The bill adds annual retailers and updates the types of fireworks that are banned within state parks. These fireworks include American Pyrotechnics Association (APA) standard 87-1, pyrotechnic devices, and flame effects.

Currently a "jobber" is defined as any person engaged in the business of making sales of consumer fireworks in Missouri. This bill replaces the term "jobber" with "annual retailer" and bans an annual retailer in any state park.

The bill modifies the authority of the State Fire Marshal to allow a fireworks permit to be revoked or suspended if there is any drug or alcohol related activity within the permitted location and refuse to issue a license or permit to any applicant that is or is in association with an individual, corporation, or partner under suspension or revocation of a fireworks permit.

This bill bans sky lanterns from use or sale in this state, except for sale or shipment out of this state.

Any person selling or offering fireworks for sale or barter or trade must allow the State Fire Marshal to conduct inspections of the business premises or any location where fireworks are stored, kept, or sold. Failure to cooperate or refusal to allow an inspection shall result in suspension or revocation of the permit or refusal of a permit to be issued.

The bill requires new construction or substantial improvement of a building or structure to submit a full set of architectural plans to the State Fire Marshal's office for review. The State Fire Marshal may accept local plan reviews of fireworks buildings or structures if the standards used by local personnel are substantially equivalent to or greater than state standards and the personnel are trained in the enforcement of these standards.
